Résumé :
En dissociant la légalité de la légitimité, l'Etat a permis de valider une production normative "contrôlée" prenant en compte les attentes des acteurs sociaux. L'ordre public social initialement prévu pour la protection des salariés se réduit à un noyau dur et peu devenir, du fait de la reconnaissance de la production normative de l'entreprise, un élément de performance de l'entreprise.
